Xóchitl Galvez Ruiz, senator for the National Action Party (BREAD), celebrated that the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI) prepare a constitutional controversy before the Supreme Court of Justice of the Nation (SCJN) against the presidential decree of Andrés Manuel López Obrador (AMLO).

Through her Twitter account, the legislator shared a video in which congratulated INAI for its decision to present a constitutional controversy against the “decree”.

In the audiovisual, the PAN assured that the federal president does not like this type of institutions because he loves to “walk in the dark”, because the Institute, he declared, represents transparency, accountability and “in short, light for citizens.”

Before her tweet, the reactions of the Internet users did not wait, as several attacked the legislator for being aligned in a party that “cynically” believes better than the current administration.

And it is that on November 23, the National Institute of Transparency announced that prepare a constitutional controversy Against the decree published by President López Obrador by which he classifies works and megaprojects as national security.

According to a statement, the INAI indicated that, after analyzing the scope of the Agreement, the Plenary of the Institute determined to exercise this constitutional control, “with which it will seek to prevent the agencies and entities of the Federal Public Administration reserve for national security, in a generalized and anticipated manner, the information related to the projects and works that the government carries out ”.

This, because the organ warned “a possible violation of article 6 of the Constitution, while national security is an information reserve budget, according to article 113 of the General Law of Transparency and Access to Public Information ”.

He also stated that the decree published in the Official Gazette of the Federation (DOF) last Monday, may violate the right of access to information, since there is a risk that the subjects obliged to generate the information of these projects may pretend to reserve the information based on the Agreement.

The INAI has a period of 30 business days, starting today, to present the constitutional controversy before the SCJN. In the coming days, the Plenary will approve the corresponding agreement in public session, with the points to be disputed and the legal arguments, ”the document reads.
