Kevin Spacey: Man who accused actor of sexual assault has 10 days to identify himself so civil case can continue, judge judge

The man, identified only in court documents as “CD,” says he met the actor around 1981 when he was a student in Spacey’s theater class in Westchester County, New York, according to court documents. At the age of 14, he began sex with Spacey, according to the documents.

Manhattan Federal Judge Lewis A. Kaplan ruled that the public had a legitimate interest in knowing the man’s identity, noting in this case “that interest is amplified because CD made his allegations against a public figure . “

“CD maintains that there is a competing public interest in keeping the identities of those who make sexual assault allegations anonymous so that they are not deterred from asserting their rights,” Kaplan wrote.

In a recent letter to the court, CD’s attorney said that “CD reluctantly decided” that he “is emotionally incapable of pursuing the action and that he will drop his claims” if the court denies his petition for proceed by pseudonym, wrote the judge in his decision.

“While CD is correct that the public generally has an interest in protecting those who make allegations of sexual assault so that they are not deterred from asserting their rights, it does not follow that the public has an interest. to maintain the anonymity of anyone who alleges sexual assault or other misconduct of a very personal nature, ”added Kaplan.

Actor Anthony Rapp, who joined CD in the civil lawsuit against Spacey, alleges the actor made unwanted sexual advances to her when he was 14, according to the lawsuit. The incident allegedly took place at the actor’s home in 1986.

CNN has reached out to attorneys representing Spacey, CD and Rapp for comment. A lawyer for Spacey told CNN she was not permitted to comment on Monday evening.

In 2017, Spacey apologized in a tweet for what he said “would have been deeply inappropriate drunken behavior” after actor Rapp made the allegations, but said: “I honestly don’t remember of the meeting. “

The lawsuit seeks unspecified damages.
