Gavin Newsom signs law making California a sanctuary for surgery for transgender children


Governor Gavin Newsom (D) on Thursday signed a bill making California a safe haven state for children to get “gender-affirming” surgery or medication.

The bill, SB 107, was sponsored by Sen. Scott Wiener (D-San Francisco), who also sponsored legislation in 2020 that reduced penalties for adults who have had oral or anal sex with an underage child. consenting within ten years of their age by removing the requirement to register as sex offenders, leaving this to the discretion of judges. The law ostensibly addressed discrimination against LGBTQ people.

SB 107 “would prohibit a health care provider, health care service plan, or contractor from disclosing medical information relating to a person or entity allowing a child to receive health care claiming gender or gender-affirming mental health care in response to criminal or civil action” from another state that prohibits transgender surgery or drugs for minor children under 18. It would also prohibit California police to execute arrest warrants for transgender treatment for minors that is illegal in their own state.

The bill “would also prohibit the enforcement of an order based on the law of another state authorizing a child to be removed from their parent or guardian on the basis that that parent or guardian authorizes their child to receive gender-affirming health care” in California.

In a signing statement, Newsom described SB 107 as a “parental choice” bill. However, nothing in the bill requires that “gender-affirming health care” be carried out with parental consent. Nor does it specify a minimum age at which a child is eligible for surgery or pharmaceuticals that would cause potentially irreversible physical changes to genitals or other organs.

The Los Angeles Times noted, “Whether SB 107 itself will be upheld in court is also at issue due to federal requirements that states must recognize out-of-state laws when residents travel.” He also quoted State Sen. Brian Dahle (R-Bieber), who pointed out that California would be in a difficult position if one parent supports a child’s transgender surgery and the other parent opposes it.
