Derek Chauvin’s lawyer files a motion for a new trial
The former Minneapolis cop was convicted on April 20 of unintentional second degree murder, second degree manslaughter and third degree murder in the death of George Floyd.

The petition, filed by attorney Eric Nelson, cites factors such as “the interests of justice; abuse of discretion which deprived the defendant of a fair trial; misconduct of the prosecutor and jury; errors of law at trial; and a verdict against the law. “

These are allegations of errors made by the judge, misconduct by the prosecution, intimidation of witnesses and the impact of advertising.

“The publicity here was so pervasive and so damaging before and during this trial that it amounted to a structural flaw in the process,” Nelson wrote.

The court also “abused its discretion” by not granting a change of venue or by sequestering the jury, Nelson wrote.

Nelson also wrote that prosecutors were at fault “including, but not limited to: denigrating the Defense; testifying improperly; and failing to adequately prepare witnesses.”
